Can the collection agency come after me for my father's debt even though I had nothing to do with it? 3 Answers as of February 22, 2012
My father passed away about 12 years ago. He didn’t leave me anything or leave a will. He had a lot of debt when he died. We weren’t that close and I didn’t live with him. I recently got a call from a collection agency asking who was handling his estate. What I want to know is can they come after me for his debt even though I had nothing to do with it?Free Case Evaluation by a Local Lawyer!

Without knowing the nature of the debt or what basis this company has for collection I can not answer your question. However, generally debts this old are not enforceable. You should consult an attorney who can review all applicable paperwork and advise you.

If it has been 12 years since he died, then the answers are: You are not liable for his debts, period. No probate was opened as there was no estate, and no estate for nay creditor to go after. A debt more than 12 years old is cleraly past any statute of limitations and cannot be collected in all events.
