Is this drug paraphernalia charge correct? 1 Answers as of June 24, 2013

My son was charged with drug paraphernalia for possession of a beer bong on a creek. He did not have any drugs on him, only beer and the whiffle base ball bat that he and his friends were drinking through. Is this charge right? Is that a drug paraphernalia charge or a public order crime? He pled guilty because he had no idea that he would be charged with drugs. He works for the railroad and has to do UA's often. He does not do drugs.
