Does my fiance still have a chance to fix his papers after drug charges? 2 Answers as of January 16, 2012

I've been with my fiance for 5 years and we have two daughters together. However, the relationship went horribly wrong last and we got in an argument that resulted to me calling police. I even accused him of hitting me though it wasn't true. I believe those charges were dropped already, only thing, he did plead guilty to the drug charges. It was the main reason for the argument in the first place. I caught him doing drugs and it bothered me so much. I love and still want to marry him but I am wondering whether he can still fix his papers? Additionally, if he came back following being deported, does that ruin his chances? I think he has a very good reason for coming back. Our youngest daughter is going to have an open heart surgery and he just need to be there with us.

It depends on the criminal history. Usually, a controlled substance offense will render a nonresident inadmissible unless it is only one simple possession in the 9th circuit before 7/11.
