Does my fathers daughter have the right to custody? 1 Answers as of May 25, 2011

My daughter's father just admitted to taking her (age 2) without my knowledge or consent for a private party paternity test. Is that against the law? We are not under any court orders for support or visitation. He is not listed as her legal parent/guardian on any document. Does he have a case for shared custody?

I would recommend that you get a court order for custody, parenting time and support. Without more information I cannot say for sure whether there is a reason that he should not be entitled to joint custody. With more information I would be happy to discuss further.
