Does an independent contractor (building websites) have the legal right to display their work in an online portfolio? Would this be covered under the fair use act? Once the independent contractor builds a site or does the work for a client, can the contractor then display that work in an online portfolio?

I can give you a definite maybe. If your contract with the client allows you to display the portfolio online you can. If it prohibits it, you cannot. If it is silent, anything that is available to the general public online can generally be shown by you or at least pointed to as a website to visit. The safe thing to do would be to get your client's permission to use their website in your portfolio.
