Do I legally have to accept an inheritance? 4 Answers as of February 22, 2011

Is there a legal obligation to act upon a notification of an inheritance i. e. either to claim or to renounce it? In other words, can there be legal penalties for not replying at all to inheritance notifications and if so, what is the time frame for that?

You can refuse to accept an inheritance. There are time limits that may apply. Just call the personal representative and let them know you want to disclaim.

If you do not reply it may be entered in by default and therefore you would receive it anyway. If you are worried about tax problems it may help to set up your own trust to have it deposited into. Otherwise, you should receive a summons and that will outline the time frame for which you have to reply to such.
