Do I have a case against a shop for selling me an unsanitary food item? 1 Answers as of January 25, 2012

I was on vacation in Pigeon forge tenn. I went to a fudge shop and purchased an item. I got back to the hotel unwrapped the item and ate 3/4 of it. The item had bugs in and out of it. I contacted the health inspector for the area. He went there and found bugs inside the item on display and in a pecan bin in the back of the store. The health inspector called me back and told me everything he found.
