Do I have any legal custody rights to my niece? 1 Answers as of July 15, 2011

Do I have any legal rights to custody to my 3 year old niece who has been living with me since August 2010. Her dad is in Army in Belgium for 3 years and her mom is in Virginia. She came to live with me because her mom had to find a place to live. Since all that has happened she had had an affair and is living with the guy and now she wants to bring the child into that situation. Do I have any legal recourse to keep her with me

Probably not, unless she is somehow endangering the child. Biology rules in Florida and only parents have rights to children in most circumstances.
