This is my first offense but a police officer found marijuana on me and wrote me a ticket for criminal possession of marijuana and said I have to show up to court and possibly pay a fine, is that all and how can I get this off my record. I want a clean record as soon as possible.

You should hire an attorney to represent you. maybe you can get an ACOD Adjournment in contemplation of Dismissal which is not a conviction it is dismissed after 1 year if you do not get in trouble during that time.

It will not come off your record- it is a minor violation but the state and the feds will keep your record- if the case is dismissed you will get your prints back from the state, never from the feds.

The police should not be giving you legal advice. They do this often to try to be a nice guy even though they have just arrested you for smoking pot, especially since many of them do it themselves. You should retain a good criminal lawyer to get you a marijuana ACD so that you will not have a criminal record. If your case is in New York State you are eligible for the ACD dismissal if you have not had one before. There is no fine on an ACD so the police officer was wrong, unless you are in another state. If you are not arrested in the next year the file will be sealed and you will not have a criminal record. Never answer the police officers questions or confess to anything. Do not consent to a search. Just demand a lawyer and let him deal with the police. They often lie and manipulate suspects to get confessions and consent to search. This usually works since criminals are stupid and do not understand their rights.

Ask the judge to give you an ACD. He can even over the prosecutions objection for a first offense. It would then get dismissed.
