Could we form an LLC while in the process of filing divorce? 6 Answers as of July 01, 2015

We are in the process of filing for divorce. We would like to form a business partnership to keep our finances, debts, and assets together for the next three years until both children finish school. Is this a possibility?

You can still form a business entity even if you intend to file or are in the middle of a divorce with your business partner/spouse.

Yes. But do consult an experienced divorce lawyer. There will be some complications I am sure you'd like to avoid.

Yes it is a possibility however it might be unnecessary. Have you considered Mediation? Mediation is a fucking fast and affordable and the mediator will draft a mediation settlement agreement on all issues. The agreement is enforceable so that it will not be necessary to form an LLC. If either party violates the mediation settlement agreement the other party can go back to court to enforce it. Good luck.
