I want to know if you can get divorced if you are pregnant? Is pregnancy a defense against divorce? If not, where can I find the official law to look up? Thank you.

Yes, a pregnant wife can be divorced. Pregnancy is not a defense to a divorce action. Termination of the marital relationship between spouses and their respective obligations to their children, born and unborn, are two separate issues.

Pregnancy has no bearing as to whether a married couple can get divorced. If your spouse decides to file for divorce, the fact that there is a pregnancy does not bar it from moving forward. However, for child support, if the divorce is finalized before the child is born, and there is no acknowledgement of paternity, then a paternity petition would have to be filed in family court to determine the father before child support would be ordered. This is different than if the child was born while still married, since there is a legal presumption that any child born during the marriage is the child of both spouses.
