Can you face jail time for a bench warrant? 2 Answers as of June 11, 2014

My fiance had a court date that we were not aware of. It is because he has moved around not having a place to stay at the time of court date. We never knew he had a court date, so he had a bench warrant for failure to appear and unpaid fines. What are the chances of him going to jail and how long?

He was made aware of his court date at the prior court date when he pleaded guilty and was given a court date to come pack and pay his fines. Since he likely plead guilty based on your question, then he can face up to the maximum punishment for failing to complete his end of the plea agreement; though a judge is permitted to give him a second chance. He should not face jail unless he was indicted for bail jumping charges which seem unlikely based on the information you provided.

Jail time is pod finks but if he shows up voluntarily and pays outstanding fines he probably can avoid a long jail sentence.
