Can we be denied citizenship because my husband has never filed a federal tax return? 1 Answers as of April 11, 2011

My husband has lived and worked in the US illegally for almost 6 years. After 2 years of marriage and a baby on the way, he has decided to seek residency via an I-130 petition and a 601 waiver. My question is: Can we be denied because he has never filed a federal tax return, and I file Head of Household?

If your denied, it likely will not be due to his failure to file a federal tax return but rather to the insufficiency of the 601 waiver hardship claim(s).
