Can they garnish my retirement wages? 2 Answers as of August 26, 2010

I have fallen way behind on my credit card payments because I do not work anymore. I only have a meager income from my retirement wages. Will the creditors be able to garnish these wages and will a bankruptcy prevent them from doing so?

A bankruptcy will protect your income. Any income can be subject to garnishment. Usually the only thing you can protect from creditors is social security income. Other than that, almost any source of income can be garnished.

A bankruptcy will definitely prevent them from garnishing your retirement. Outside of bankruptcy, I am not 100 percent sure, but I think California exemptions protect the retirement accounts in the amount reasonably necessary for your support and maintenance.
