It was their fault as the police report shows. The driver was the insured person's 18 year old daughter and the mother was in the car with her.

The last time I looked at policy language, coverage included permissive drivers, so I'd think coverage applies. You need to see the actual insurance contract to figure it out. If there is no coverage for them, use your uninsured motorist's coverage. If you don't have it, get it. It's the best insurance value.
