Can a tenant break the lease over a square foot estimate? 3 Answers as of August 30, 2011
As a landlord I was in the middle of a dozens showings on a great property when an out of state couple wanted additional pictures of the property, after I supplied them they asked for square footage. I told them they were estimates because I was not over there. I estimated overall sq ft of 1100, it might be closer to 1040 after investigating. The one problem they say is one bedroom was est 12x13 and it's is 10x10. Because of this they refuse to take possession of an otherwise great unit. I mentioned via email this was only an estimate and they quickly took the unit I would have been happy to go measure or take more pictures but they quickly came back and said they wanted it and signed the lease and sent the security deposit. Can they break the lease over this? Can we take them to court for the two months rent we are out now that we relisted and it’s empty for 2 months?Free Case Evaluation by a Local Lawyer!

Square footage does not seem like a valid reason for breaking a lease. Whether you can sue them for the two month's rent depends on what the lease said regarding default and/or early termination.
