Can a state attorney deny pre release after the judge has already signed off on it? 2 Answers as of November 03, 2011
My boyfriend was sentenced to 2 1/2-6 and has done 18 months. He went for pre-release to a half way house and the judge signed off on it, but then the state's attorney called the jail to say that he didn't feel he should get pre-release. How can he overrule the judge?Free Case Evaluation by a Local Lawyer!

A litigant should not be able to unilaterally and ex parte overrule a judge. Hire counsel to explore that issue.
