Can spousal support be back dated to date of separation? 1 Answers as of June 01, 2011

My soon to be ex and I have agreed on spousal support, If I am not paying now When does it go into effect. Can they backdate it to the date of separation? Or is it the date of the divorce.

If there is a motion for temporary spousal support before the court, spousal support will relate back to the date of the motion. Otherwise it will start if you agree to a specific date; or usually as of the date of the Judgment of Dissolution of marriage. Thanks.
