Can a roofer who fell come back and ask for money? 2 Answers as of April 04, 2017

My husband and I have a small roofing company. The guy who fell off the roof gets paid with 1099. He came and talked to us about giving him $3000 and that's it. He said write a letter we all sign and it's done.

You need Workers compensation on all employees. The fact you give him a 1099 doesn't make him a non employee. You better hire a lawyer.

Do you have a contract with the guy? If not, it is POSSIBLE that he may be determined as an employee, rather than an independent contractor. If he is an employee, you MUST provide workers compensation coverage for him. I do not have enough information to give you a solid answer.
