Can police search your car without permission in north carolina? 1 Answers as of June 13, 2011

I was driving our SUV and a NC sheriff pulled us over because my husband's ex wife told him that we had someone in our vehicle that shouldn't have been in the presence of their 7 yr old daughter. Can the officer search our vehicle without my husband's or my consent?

Under these facts, probably. This will likely be deemed a circumstance where a warrant was not required because of the exigent circumstance of the person being in a car. Therefore they will just need to establish probable cause for the Sheriff's belief that the individual was in the presence of a child that he was not supposed to be around. This will likely come from the statements of the ex-wife.
