Can the police enter a house without a valid search warrant? 1 Answers as of December 19, 2011

If a cop comes to a house looking for somebody with a warrant and that person isn't there, but they say they smell pot, can they enter the house even after the lease holder says wait to get a warrant? Also they forcibly entered and took pictures before having a warrant and did a "protective search" but made no mention of it until after the fact of the drug dogs being there. In short, is there a case for foul play by the cops?
