Can the other party claim on damages to their vehicle though they just got an estimate and didn't get it fix and sold the vehicle the way it was? 2 Answers as of May 05, 2014

My insurance said it wasn't my fault and didn't pay the other party. The other party sued me. I thought I had a good case but I lost the case. I was wondering, if I am the right party? Shouldn't the other party sue my insurance and not me in the first place?
