Can my stepson choose where he wants to live? 2 Answers as of June 30, 2011

My 17 year old stepson lives with his mom, but he has decided that he wants to move in with his Dad and I for his Senior year in High School. What happens if his mom says he can't stay with us? We are going to go through the courts, but wanted to see if he has a choice as to where he wants to live.

The courts will take his testimony as to where he would like to reside into consideration but will ultimately based its decision upon what is in the best interest on the child.

The choice is ultimately with the court but the judge will give credence to the child's preference. Unless the judge has specific concerns with the preferred living arrangement, a 17 year old would most likely be allowed to choose where he lives.
