Can my roommates come after me if I file for bankruptcy? 14 Answers as of October 21, 2014

After certain issues and a police report filed against my roommates, I decided to leave my apartment because I could not take it anymore. They did not want to release me from the lease so I just left. I am filing for bankruptcy and want to know if they can come after me for the amount owed.

As long as you listed them as creditors, they can't come after you for any debts.

the filing a petition will protect you from most debts that are owed prior to filing. Mare sure you list the roommates and the landlord as creditors.

If you committed a crime, your roommates can certainly file a police report and you can be held responsible for making restitution in order to avoid prison time. But if you did not commit a crime, then you should list your roommates as creditors in your bankruptcy and tell them to finish their legal education & pass the bar exam before making threats to charge someone with a crime to collect a civil debt ? because making a threat like this is a crime.
