Can my husband file for a reduction in alimony? 3 Answers as of October 11, 2011

My husband wants to file for a reduction in alimony with his ex in N.J. He is now making 1/4 of what he was then when his alimony was set in 2007. What we need to know does my income count along with his for this motion or is it just his income that counts?

You can't get what he doesn't have if he doesn't have it due to no fault of his own. For example, if he earns only 25% of what he was earning in 2007 because he was laid off and has not worked for three years and could only find a job paying substantially less, the court might thing of that situation as a changed circumstance requiring another look at the alimony number. And, yes, your ability to take care of yourself counts.

You income only counts for computing your husbands support obligation for any child he has with you. That number is inserted into the program for calculating his income based on his income and the income of the child's mother.
