My husband wants out of the marriage. He canceled my credit card and phone. He has not filed any papers. Can he do this?

If your husband signed up your phone and credit card, he has the power to cancel them. Your best bet would be to retain an experienced Family Law Attorney to represent you, and to file a divorce case and an Order to Show Cause for Spousal Support and Attorney's fees.

If they are in his name alone, probably but only so long as no dissolution of marriage petition has been filed. Once a summons has been issued there are standard restraining orders in place so neither of you can do anything to change the status quo until after a hearing or settlement. If you have been on a joint account and your husband cancels it, contact the creditor and tell them you want your consumer rights observed and you want a credit card/ phone/etc in your name and your credit.

As long as no divorce case is pending your husband has free rein to act as he pleases with your credit availability. If the cancellation of the credit was very recent we can obtain an Order from the court to reinstate your credit, if the creditor will agree. If you wait, you will lose your possibility to have the credit restored. Additionally, he may take other acts against you so wisdom would dictate that you act now to legally restrain him from further adverse consequences.

If you hold these accounts jointly, he may have the ability to cancel the accounts. When you file your divorce action, you should file a motion to have husband reinstate these accounts and/ or reimburse you for any expense you incur on re-establishing the accounts.
