Can my husband be jailed after illegally entering the US after a voluntary departure? 3 Answers as of January 26, 2011

If ever amnesty will be given in USA will he be included? Even if he makes a voluntary departure, will he still be apprehended in the USA? Or even in our home country? We are not American citizens, he has no entry in the US. What if I apply in an international organization, can he be my dependent and will that remove his being out of status? We were married for 3 years now and we have a son who is with me in our own country. I am worried about not seeing him again. Can he be jailed once he goes home in our own country even if its a voluntary departure?
