Can my former employer hold back my last check? 2 Answers as of July 15, 2011A former employer is saying that I quit but I have proof that I got fired. They are saying that they need a written letter addressed to their accountant, what do I have to do with their accountant? She hand writes the checks right then & there. If you were fired your last paycheck is due at time of firing. If you quit, it is due within 72 hours. Failure to pay is a violation of the labor code and permits you to claim a days wages for each day that payment is illegally withheld.
