I am 17 years old, turning 18 in January. My mom had full legal/physical custody of me. Then she kicked me out in June and told me I had to live with my biological dad. My boyfriend is in the Airforce and is potentially getting stationed overseas. You will need to inquire of your county clerk. In Los Angeles county, a minor must provide a Notarized Parent or Guardian Consent Statement and an order of the Superior Court granting the minor permission to marry, in order to obtain a marriage license. Inquire of your county clerk if the Consent Statement needs to contain the consent of both parents, or if the consent of only one parent will suffice.

You may file for an emancipation which would allow you to get married. Your father can consent and you would need to provide notice to your mother. After you are a legal adult, you will be able to get married.

Although theoretically, your father could give permission without being the custodial parent, the court must make an order allowing you to marry and, realistically, that won't happen before you turn 18 in January. You should probably just wait.
