By your inquiry, it appears that you remain legally married to your husband, even though you have been physically separated for about 17 years. I would assume that neither you nor he have contributed towards any assets that you and he have acquired over that time, including specifically the funds used to purchase the lottery ticket(s)that you speak of. If that is true, while they are technically marital property, it would be inequitable for him to share in the winnings; and NY has Equitable Distribution. If I were the judge, he would get none of it.
