Can a levy for 20 year old taxes be released? 1 Answers as of May 05, 2011

IRS levy put on in 1992 against litigation in process. Levy was released in 2008; the levy was for tax yrs. 1978 - 1993 not all years in between. Can the levy be put back once it has been off for taxes owed 20 + years ago?

If the tax return had been filed with the IRS, and the levy was fully released, the answer would be no. If the tax return was never filed, then the statute of limitations never starts. If the levy was not released on the litigation and money is now paid, then the levy can apply.
