Can the IRS go after inter-spousal gifts in Montana? Posted on January 10, 2011

Lets say I get married in Montana, then "gift" my spouse my assets I had before the marriage under the IRS Interposal gift laws. Then say 5 years from now should I have difficulty on some future tax issues can the IRS "go after" those assets I gifted my spouse, or is it truly her property at that point under Montana and the IRS would have no claim?
