I am a mother of 2 and i am thinking about moving to Florida. I recently separated from my husband can I legally take my kids with me without his permission. We are not legally separated.

You need to file suit for divorce, and obtain a temporary order giving you custodial rights before you move to Florida.

Both parents are entitled to custody of the minor children. Both parents should have access for visitation with the children. If there is no order in place no one may restrict you from moving. However, you may have to arrange and pay for transportation for the children to visit with there father. I would suggest that you retain and attorney in this matter.
