Can I sue the bank who gave a loan to someone who was using my social security number? Posted on July 15, 2011

If a major bank allowed someone to use my social security number to get a mortgage loan can I sue them. They did not (the bank) report this loan to any credit bureau so it has never shown up on my credit reports. I only found this out recently when applying for a home loan and the bank I am using did a MERS report and this loan showed up. I believe, since the bank didn't report it to credit bureaus, they knew that they person who got the loan was not the real owner of the social security number.
