My boyfriend traded his truck for my friends car so we could fit the kids. The bill of sale was in both our names but is lost, the title is still in my friends name. We broke up and he is trying to take the car from me which I have possession of. If both names are on the Bill of Sale than both names should also be on the Title of the vehicle. The only time this does not happen is when the new owner does not apply for a new title with the DMV. For purposes of the DMV and selling the vehicle however, the only necessary signature is one which matches the name on the title. Thus, if the Bill of Sale is lost, it is likely that the name on the title will be the legal owner of the vehicle.
