Can I receive court supervision? 2 Answers as of May 16, 2016

Arrested for a DUI in 12/2002 and dropped to reckless driving and underage consumption that was dismissed with diversion in 9/2003. Just was arrested this weekend, can I still get court supervision?

This is your second arrest for DUI. You probably will not be offered supervision, but in any case, you should try to get supervision. You will definitely need a lawyer to plead your case to the prosecutor, and perhaps, the judge. It is not an impossibility, but I would say it will be difficult to get supervision. Your chances improve significantly if you hire a good defense attorney.

No, your DUI reduced to reckless precludes you getting supervision on this offense.
