My fiance had a valid visa when he entered the US. He has never been in trouble with the law. I was born here and I am a US citizen. Can we legally get married? What do I have to do to make him legal?

You can certainly marry your boyfriend the U.S. Family law is State law. So long as a social security number is not required in the State, there is no law against it. Since you boyfriend entered the country legally (with a valid visa) he may be out of status but still has status to adjust to immigrant status. You will need to do a I-130 Family petition, and I-485 request for an adjustment of status.
