Can I let my daughter move in with her mother if I have custody of her? 9 Answers as of January 18, 2012
I have custody of my 17 almost 18 year-old child. She wishes to move in with her mother so she'd be able to get some financial support for college. I refuse to aid her in paying for any tuition. Is it illegal for me to let her live with her mom before 18?Free Case Evaluation by a Local Lawyer!

So long as your daughter is safe, it is not illegal. In fact, any agreements two parents can reach will supercede an order. Just so you know, though, your income will be used in financial aid calculations for your daughter's education. You may want to re-think your refusal to assist her - a college education will go a long way toward assuring your child can be an independent adult.

It isn't illegal, but the order should be changed, and may be required by the financial aid dept that she is seeking assistance from. You can file a stipulation and have it signed by the judge.

No unless there is a restraining order in effect. However a court (custody) order is a court order and so I suggest you prepare a Stipulation and Order, both of you sign it, and send it in to the Court for the Judge's signature and filing.

No. If her mother is more supportive of her education than you are, let her move. You not only won't be committing a crime - you'll be doing your daughter a favor.

This change is not illegal (criminal) but it deviates from your existing custody order. Best to modify and file an order to reflect this new parenting arrangement.

If you have custody and want to allow her to move with her mother, you can allow her to move. You can stipulate to a change in custody and file it with the court.

It is not illegal. The best way to handle it is to draft an agreement and then have the judge sign it so you are both in compliance with the current order.
