Can I have more time to get the attorney's signature? 22 Answers as of January 16, 2012

They found atterol residue on a bag in my truck and got a felony. I had to have lawyer sign the pink paper. I showed up and asked for more time and judge gave me a week to get it but the lawyer's office was closed. Can I go to court and ask for another week or would I get locked up for not having the attorney's signature?

You should be able to get more time but I question hiring a lawyer who you could not reach at least by phone. Think about trying to reach the lawyer when the lawyer has been paid.

Explain to the judge the reason for the delay and most times the judge would give you the additional time.

You should consult with an attorney as soon as possible, and if the attorney you are trying to hire is not available, possibly seek a new attorney. But if you explain the situation to the court, and can bring some somrt of verification that you have tried to call (i.e. your phone records), then the judge should give you some more time to get the needed information.

Well, it depends on the Judge. I would try to bring proof showing the attorney's office is closed.

What paper? You didn't "get" a felony, you earned it. If you need the attorney to enter a Notice of Appearance, the attorney should be available on Monday. If your court date is before then, the court should allow you more time due to the holidays. I hope your next hearing isn't a trial because your attorney will be woefully unprepared.

These appear to be circumstances beyond your control. I feel if you explain the problem to the Judge and make the Judge feel that you have exercised dilligence in attempting to get this accomplished, he should provide you with additional time to get the needed signature.

Your post is confusing. It is unclear what document the court requires or why it was signed by a lawyer. Nonetheless, you may always seek a continuance which the court may grant in its discretion if it does not contribute significantly to the length and delay of the proceedings or prejudice either party.

I would bring a witness to show you went to the lawyer's office and it was locked. Better safe than sorry. Second, if there is a voice recording saying we are closed, be prepared to show that too.

I dont know what you mean by having the lawyer sign pink paper. In Wyoming, you can go to court and ask for additional time to find a lawyer without much issue, unless you are in city court.

It is unclear what you need a signature on but it would seem that if you could not get it after diligently trying, asking the court for more time would be an option.

I have no idea what you mean by "the pink paper". You should retain an attorney to handle the case, especially if it is a felony. If the judge told you to get an attorney and you show up without one he may change the terms of your bail. If his office was closed for the holidays the judge may understand and give you another week. You should always ask for your lawyers cell number.

I suspect that the judge will give you some additional time, especially in light of the holidays; but I suspect that he/she will also give youy a lecture that the case will be moving forward with or without your attorney. This is done to encourage you to move forward.

From the limited amount of facts you provide, I do not know what signature you are referring to regarding your attorney. I would need more information about what you really need. You could file a motion to extend the period of time to obtain the signature based upon the unavailability of your attorney.

Once a judge gives you a continuance for one reason then it depends on the judge, the reason for the continuance and what court action the required continuance is for. If the only thing you need is a small amount of time the judge should give you more time. In the case where you had a week to get a paper signed by your attorney and his office was closed during the entire time the judge should give you another week. You will need to bring in proof for the reason you could not get it signed.

If you have hired an attorney he should be assisting you with this. You should be able to get in contact with your lawyer. You mention pink slip. I am guessing tis is an MVD admin per se form? I don't know why you need your attorney's signature. It is unclear what you are trying to do. If you have a court date coming up and you retained a lawyer he/she should be going with you. What is the form for?
