Can I have a judge freeze my Dad's assets until I can be heard in court? 1 Answers as of January 07, 2012

My Dad has dementia. My brother has taken advantage of this to have my Dad change his will to favor my brother. What I would like to do is have a judge freeze all of my Dad’s assets (upon his death) until I can be heard in court. Is this possible?

Your dad cannot change his will if he is not competent. Mental disease usually makes one incompetent to form the intent to make a new will.
