Can I go to trial for a personal injury case after agreeing to a settlement? 1 Answers as of June 22, 2011

I have a personal injury case and my lawyer tole me to take the settlement even though he claims the case is totally winnable. The other side has yet to send check and release after I agreed to settlement over two weeks ago. Can I tell my lawyer to contact their lawyer and tell them to forget it and move for a trial because it's been 4 years and they always seem to stall or delay me?

A deal is a deal. If you and the lawyer gave your word that should be the end of it. the lawyer would not let you settle if he thought he could do better without risk. The court can force you to sign the papers if you do not.
