Can I get out of a lease if it is a medical issue? Posted on July 08, 2011

My next-door neighbor smokes and it enters my apartment on a daily basis. I have asthma and allergies and the effects are getting progressively worse. I have kept a detailed journal, spoke to tenant respectfully, spoke to landlord, seen a doctor (willing to write letter). Do I have any legal rights? I just renewed my lease two weeks prior to this tenant moving in or else I would not have renewed it. I am desperate due to my health and well-being. The does not have a no smoking policy but it does discuss nuisances. Thank you.
