I met my fiancée over a year ago while she was here in the US on a tourist visa. She went back to her country for 9 months and will once again return to the US on her tourist visa. My question is: Can I marry her while she is on a tourist visa? You can get married if she enters on a tourist visa. However, if you then want to petition for her adjustment of status as she entered on a tourist visa, that can also be done but it needs to be strategized correctly so as not to cause her to be ineligible for the benefits.

If she comes here on a tourist visa with the intent to visit and you decide to get married while she is here, she will be able to adjust her status to permanent resident while here. A fianc?e visa is only for someone who is overseas.

If she enters with a tourist visa she can decide to marry however, she cannot enter with a tourist visa with a preexisting intent to marry and stay permanently. The latter requires the k1 visa. It is all about the intent at the time entry.

Yes, you can absolutely marry her in good faith when she returns for another visit. She will be allowed to adjust her status here in the US as an immediate relative and it should take no more than 6 months for her to get her conditional Green Card.

Yes. You can marry someone on a tourist visa and apply for the green card. You don't need a fiance visa if the person is already here. And the entire green card process only takes about 3 months from start to finish.

Your fiance can apply for a green card as your spouse after entering the U.S. as a tourist but cannot enter to get married. You would have to apply for a K-1 fiance visa to do so. I recommend that you consult with an immigration attorney regarding both options.
