Can I get denied aK1 and get a ban? 2 Answers as of January 20, 2011

I worked as au pair on j1 visa, but I had a second job at the store. I gave my SSN . It is valid for work only with DHS authorization and I think I filled in I9. I worked for 2 months part time. Can I get denied in K1?

I need more facts to properly advise you. Are you in or out of the U.S? You may potentially be required to also file an I-601 waiver for the unauthorized employment and show extreme hardship to your U.S. citizen fianc.

Yes, prior violations of the immigration law, such as working without authorization, can result in the denial of another non-immigrant visa such as a K1. However, it is not an automatic denied and you should consult with an immigration attorney before filing the K1.
