Can I be sued for defamation of character? 5 Answers as of April 09, 2013

My soon to be ex has been having an affair with a friend for months. I made a poor choice of judgement after an argument with him to post on line a picture with names outing her and him. I removed it the next day knowing it was wrong.

Unlikely you'd be sued for defamation but bad judgment can be used against you in child custody.

Truth is a defense to defamation. There are other causes of action like publication of private information, but unless you made an additional statement that was untrue about either of them, you would likely prevail in a defamation of character lawsuit. That does not mean that they could not file the lawsuit, it just means that you would "likely" eventually prevail. You should consult with an attorney in your area, as soon as possible.
