Can I be charged even though I didn't know my son had marijuana? 1 Answers as of June 02, 2016

Police raided my son's house about 2 hours after I got there. He admitted having 35 grams or less of marijuana. No one was arrested. Two months later, they charged him. They are charging me with possession also.

Yes, because of "Constructive Possession." It means that the police (and the judge) believe that everyone in the house knew that the marijuana was there and had access to it, so everyone who lives in the house is getting charged with possession. You can hire an attorney to represent you and your son if you want to get the charges dismissed or reduced to a lesser offense.
