Can I avoid jail time for first offense for credit card fraud? 1 Answers as of June 20, 2016

My friend’s grandmother had a stroke. She’s her caregiver and she was admitted to the hospital and the grandmother’s son needed money for hospital, parking, gas and food. Uncle coheres me to use the grandmother’s bank credit card at the drive through to get money even though my friend agreed to pay half of it back but the bank is already investigating. It’s her first offense though.
