Can I ask the father of my child for child support if we are not married and he is in the US? 2 Answers as of December 05, 2011

The father of my child and and I got engaged decided to apply for a K1 visa, he visits me here in the Philippine for a couple of times. During the process of our K1 visa, I found out that he got me pregnant. When I gave birth to my child he decided not to pay for anything because he says his not the father of the baby. I told him that I wanted to do a paternity test, but he declines it. And now I am supporting my child alone. And now he doesn't want to talk to me anymore, he basically disconnected me out of his life. At first I planned not to go through with this child support process, but a lot of people advised me not to let this man just turn his back on his obligations. I need help his in the US and in here in Philippines.

I would advise that you write a letter to the Virginia Division of Child Support Enforcement(DCSE) explaining your situation to determine whether there may be an agency in the Phillippines with which it could work in order to establish paternity and a support obligation in behalf of your child. I don't know much about family law, however it looks like you need to take him to Court in the Philippines and not here in the US. You have to establish somehow that he is the father of the child. Consult with a Family Law Attorney. Good luck!
