Can I apply for workers comp after being injured while giving my boss a ride? 1 Answers as of November 16, 2010
Recently demoted, my supervisor asked me for a ride. I was injured in a motor vehicle accident while driving her. I did not feel I could refuse giving her a ride, as I feared for my job.Now I have been out of work 3 months. A spine specialist says that I need surgery, and short term disability will drop to 60% pay as of the first of December. I cannot survive on that and cannot yet go back to work, if ever.
I do not know what to do. I was told that I could not apply for workmans comp. Then I was told I could but would not receive it, and it would delay any short term disability.

Generally, if you are working at the time of the accident and/or performing duties for the benefit of your employer, you may qualify for benefits. There are many factors that may need to be considered to determine whether or not you would be eligible for benefits. I would highly recommend contacting an attorney to discuss your situation in greater detail before deciding not to pursue a claim.
