Can I apply for H1 while my F3 visa is filed by my mother in law? 2 Answers as of June 20, 2011

My mother in law has filed my wife's file under F3 category in 2005. My current date is June 2001. Once the priority date becomes the same as 2005, I can come with my wife to US. Now I have an offer to work on H1. I am currently in India. If I go ahead with H1, will it impact my immigration filing of F3 category?

No filing the non-immigrant visa will not impact the Immigrant visa filed by your mother. You may be asked by the custom border protection officer about your intention to remain in the U.S. once you enter.
